ShakePin Terms of Service

1. Introduction

Welcome to ShakePin. These Terms of Service ("Terms") govern your use of the ShakePin software application ("ShakePin" or the "Software") provided by Ahmad Arif Aulia Sutarman ("we", "us", or "our"). By using ShakePin, you agree to these Terms. If you disagree with any part of the terms, you may not use our Software.

2. License and Use

2.1. Open Source License: ShakePin is licensed under the MIT License. The full text of this license can be found at [link to MIT License].

2.2. Permissions: Under this license, you are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of ShakePin, subject to the conditions outlined in the MIT License.

2.3. FFmpeg Usage: ShakePin uses FFmpeg, which is licensed under the GNU Lesser General Public License (LGPL) version 2.1 or later. The source code of FFmpeg and any modifications made to it are available at https://git.ffmpeg.org/ffmpeg.git. By using ShakePin, you agree to comply with the terms of the LGPL with respect to the FFmpeg components.

2.4. Attribution: We request that you provide appropriate attribution to ShakePin and FFmpeg when using or distributing the Software.

3. Premium Support

3.1. Support Plans: While ShakePin is free to use under the MIT License, we offer premium support plans for users who require direct assistance from the developer.

3.2. Support Terms: By purchasing a support plan, you agree to the following terms: a) Support is provided on a best-effort basis and does not guarantee resolution of all issues. b) Response times may vary based on the complexity of the issue and current support load. c) Support is limited to the current version of ShakePin and may not cover modified versions. d) We reserve the right to terminate support for users who abuse the service or violate these Terms.

3.3. No Additional Rights: Premium support plans do not grant any additional rights or licenses to the Software beyond those provided in the MIT License.

4. User Responsibilities

4.1. Lawful Use: You agree to use ShakePin only for lawful purposes and in accordance with these Terms.

4.2. No Harmful Use: You must not use ShakePin in any way that could damage, disable, overburden, or impair our services.

4.3. No Reverse Engineering: While the Software is open-source, you agree not to attempt to reverse engineer or bypass any security features of the premium support system.

5. Intellectual Property

5.1. Ownership: Except for the components covered by the MIT License and LGPL, we retain all right, title, and interest in and to ShakePin, including all related intellectual property rights.

5.2. Feedback: If you provide any feedback or suggestions regarding ShakePin, we may use this feedback without restriction and without compensation to you.

6. Disclaimer of Warranties

6.1. "As Is" Basis: ShakePin is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied.

6.2. No Guarantee: We do not guarantee that ShakePin will always be safe, secure, or error-free, or that it will function without disruptions, delays, or imperfections.

7. Limitation of Liability

7.1. Exclusion of Damages: To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

7.2. Cap on Liability: Our total liability for any claim arising out of or relating to these Terms or ShakePin shall not exceed the greater of $100 or the amount you have paid us for premium support in the past 12 months.

8. Changes to Terms

We may modify these Terms at any time. We'll post notice of modifications to these Terms on this page. Changes will not apply retroactively and will become effective no sooner than 14 days after they are posted. However, changes addressing new functions for ShakePin or changes made for legal reasons will be effective immediately.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Indonesia. Any dispute arising from or relating to these Terms or the use of ShakePin shall be resolved through binding arbitration in accordance with the laws of Indonesia.
